Overview

Full scholarships and discounts to attend PLI programs are widely available to attorneys working in nonprofit/legal services organizations; pro bono attorneys; government attorneys; judges and judicial law clerks; law professors and law students; senior attorneys (age 65 and over); law librarians and paralegals who work for nonprofit/legal services organizations; unemployed attorneys; and others with financial hardships. We encourage all eligible attendees to complete and submit a PLI Scholarship Application

Why You Should Attend
The increase in enforcement actions and the detention of immigrants in our communities presents serious problems with regards to due process and adequate access to counsel. For immigrants who have been apprehended at the border or arrested in an enforcement action, expressing a fear of return to their home country may be the only thing which prevents their immediate deportation. This program will focus on Credible Fear Interviews and Reasonable Fear Interviews (CFI and RFI’s), providing an overview of the practice and procedures for these interviews, and the best strategies to prevent deportation and provide immigrants their day in court. This training will focus on practices and resources in Northern California.

What You Will Learn
We will provide a general overview of the current immigration landscape, and focus on how immigrants with a fear of returning to their country can raise claims for protection through credible fear and reasonable fear claims. The second half of the program will focus on logistics and practical application, and strategic considerations when providing rapid response assistance or representing a detained client.

Who Should Attend
This program is designed for all attorneys interested in issues related to due process and access to counsel in immigrant communities, as well as the recent trends in enforcement and removal.  No immigration experience is necessary, and CFI/RFI’s are a good starting point for volunteer attorneys interested in providing limited scope representation to immigrant communities. Supplemental materials and references will be provided for those interested.
