Overview

Usage of AI in industry is becoming ubiquitous and poses complex legal challenges. However, barring changes in law, the current legal regimes for tort, commercial and IP law largely control the usage of AI and agreements involving AI technology. This session will provide guidance on navigating the sophisticated landscape of such agreements, and discuss practical policies a business can implement with respect to AI usage.  Huu Nguyen and Stephanie E. Niehaus, each of Squire Patton Boggs LLP, will provide a multi-disciplinary discussion of potential pitfalls in AI usage and agreements, including the following topics:

  • Relevant categories of intellectual property to consider in AI agreements
  • Relevant representations and warranties to include in agreements governing the use of AI
  • Tort based considerations and strategies related to AI
  • Real-life examples of pitfalls in AI usage and agreements
