Overview
Generative artificial intelligence (think ChatGPT, among others), appeared in late 2022. GAI is now embedded in the popular imagination and, increasingly, in products available to attorneys as well as their clients. Moreover, GAI is attracting the attention of regulators and legislators across the Nation. All this means that attorneys should be prepared to understand and use GAI, advise their clients about GAI, and address AGI in investigations, regulatory proceedings, and litigation, This presentation will examine GAI from the point of view of attorney ethics, explore the “ethics” of using or advising about GAI, and suggest best practices for attorneys who do so.
Faculty discussion will include:
- The nature of GAI and how it is being used (20 minutes)
- The Model Rules of Professional Conduct and GAI (15 minutes)
- The Federal Rules of Civil Procedure and GAI (15 minutes)
- What the future might hold (10 minutes)
