Overview

Why You Should Attend
In the last several years, California has passed landmark laws to create new opportunities for conviction and arrest record dismissal and sealing in ways never previously possible. While some laws will be implemented as “automated relief” at the California Department of Justice, many of the millions of Californians eligible for relief will benefit from the guidance of a legal advocate familiar with the contours of the new laws, and proficient in the benefits and limitations of various forms of record relief in California.

Even with these expanded record clearing opportunities, a person with a prior record may still face significant barriers to employment, occupational licensing, and other opportunities, no matter whether the record is old or relatively minor. Additionally, immigrants face the threat of deportation based on criminal legal contacts as minor as an arrest that did not result in conviction. This training is designed to give lawyers, community members, and other advocates a foundation in the collateral consequences of contact with the criminal legal system. You will also hear from advocates who have been striving to further minimize these consequences through creative strategies.

What You Will Learn
After completing this program, participants will be able to:
• Recognize criminal record remedies in California and strategies for different forms of advocacy 
• Understand the intersection between Immigration and Criminal Law and effectively counsel noncitizen clients
• Define participatory defense and implement community organizing and advocacy strategies
• Understand the provisions of California’s Fair Chance Act and efforts to strengthen fair chance employment protections 
• Define the Child Abuse Central Index and assess the employment consequences of inclusion and possibilities for administrative advocacy  


Who Should Attend
All attorneys interested in or currently assisting pro bono clients with reentry legal services through representation or in clinical settings, law firm pro bono coordinators, managers, and partners, law clinic students and faculty, and public interest and nonprofit organization attorneys and staff would benefit from attending this program.
