Overview

The enactment of the National Defense Authorization Act for Fiscal Year 2021 is the most significant overhaul of the Bank Secrecy Act and related anti-money laundering laws since the USA PATRIOT Act of 2001 and includes bringing the AML whistleblower provisions closer in line with the SEC’s whistleblower program.  If the SEC’s success is an indication, the new AML whistleblower program will lead to increased regulatory inquiries and enforcement.  Indeed, in the 10 years since inception of the SEC’s whistleblower program, the SEC has received more than 26,000 whistleblower tips and awarded more than $700 million to 134 individuals.
