New USPTO rules, guidelines and programs have been implemented to promote the accuracy and integrity of the trademark register. Joseph Agostino of Greenberg Traurig, LLP will help you deal with the following changes and protect your clients’ applications and registrations from undue scrutiny and potential invalidation, including:
- Post Registration Proof of Use Audit Program – The USPTO randomly audits registration maintenance filings to help preserve the trademark register as a reliable reflection of marks used in commerce.
- Specimens – The rules concerning specimens submitted to demonstrate actual use of a mark have been revised to more clearly reflect the requirements of actual use. This especially applies to labels and tags and webpages.
- New owner email rule where email addresses of owners must be provided so the USPTO can communicate with trademark owners in certain instances. This also invites another avenue for spammers.
