Overview

Managing infringing domains and cybersquatters is a growing area of concern for brands, as these domains are used not only for parking pages that generate revenue with misleading ads, but also to launch malware, phishing, and impersonation attacks, including impersonating the brand’s customer support and hiring teams. 

Faculty will focus on best practices for monitoring domain names, establishing internal protocols and communications for in-house teams, and identifying levels of risk and options for enforcement, including Uniform Domain Name Resolution Policy (UDRP) and other arbitration proceedings, Anticybersquatting Consumer Protection Act (ACPA) litigation, and other options.

The following topics will be discussed:

  • An overview of cybersquatting trends and challenges (10 minutes)
  • Internet Corporation for Assigned Names and Numbers (ICANN) domain name governance and resolution framework and latest developments, including UDRP, URS, and other proceedings, and Web3 developments (30 minutes)
  • ACPA litigation and other enforcement options (15 minutes)
  • Best practices for in-house teams (5 minutes)
