Overview

Much of the news and activity surrounding the No Surprises Act (NSA) has focused on the Independent Dispute Resolution (IDR) process for providers and payors and legal challenges related to the regulations implementing that IDR process.  But the NSA contains an array of additional provisions impacting ERISA plans and their administration that are ripe for DOL auditing and enforcement.  Learn about those obligations on plans likely to be the focus of DOL audits, DOL’s compliance assistance and enforcement policies relating to key NSA provisions, and what plans, plan administrators and plan service providers should expect regarding DOL enforcement of the NSA.  Topics to be addressed include:

  • Overview of No Surprises Act provisions enforced by DOL (10 minutes)
  • Regulations and anticipated rulemaking (10 minutes)
  • DOL compliance assistance and enforcement policies (15 minutes)
  • Anticipated focus areas for DOL enforcement (15 minutes)
  • How to prepare for an audit (10 minutes)

Who Should Attend:  In-house counsel, outside attorneys, pension plan counsel, compliance, healthcare and other allied professionals interested in learning what to expect regarding DOL enforcement of the NSA
