Negotiation in Mediation and Other Alternative Dispute Resolution (ADR) Settings

This program will provide an overview of ADR options, including mediation, arbitration, early neutral evaluation, and private jury trials, and will detail key strategies for effective negotiation in mediation. After completing this session, participants will be able to: 

• Understand court-sponsored and private ADR options
• Assess mediator and arbitrator styles and qualifications and negotiate the potential terms of a mediator’s proposal 
• Position themselves as a resource for the mediator while maintaining competitive advantage
• Propose and interpret brackets
