Overview

The Federal Arbitration Act (FAA) mandates enforcement of arbitration clauses.  Except when it does not.  In this One-Hour Briefing, Justin N. Kattan and Justine N. Margolis of Dentons US LLP will focus on enforcement of arbitration clauses in insurance related disputes.  

Specifically they will discuss:

  • The practical impacts of federal law granting to the states the power to regulate the “business of insurance” under the McCarran Ferguson Act (MFA)
  • The ways in which different states have used the MFA to prohibit or limit the use of arbitration for insurance disputes
  • The use and enforcement of arbitration clauses in commercial versus consumer insurance contracts
  • Issues to consider when drafting arbitration clauses for commercial insurance contracts
