Motor Vehicle Technology Update: More Data, More Lawsuits

    1-hour program
    Up to 1 credit

    Overview

Multiple lawsuits against Tesla are scheduled to go to trial this year involving serious or fatal crashes that allegedly occurred while the driver was relying on Autopilot. Tesla recently settled an alleged Autopilot-related crash case and obtained a defense verdict in another. The National Highway Safety Administration has announced a new review of Autopilot and drivers’ overreliance on the technology.

General Motors is facing class action lawsuits in which drivers allege that the company collected and shared driver data, including information about speeding, braking and acceleration, without their consent with third parties including insurance companies. In March, GM announced that it planned to stop collecting driver data and to end its relationships with certain data brokers.

    Our speakers will discuss:

    • An overview of the allegations in the lawsuits against Tesla and GM (10 minutes)
    • The causes of action and theories of liability asserted in these cases (10 minutes)
    • The role of NHTSA, the FTC and other agencies in the regulation of automotive technology (10 minutes)
    • Questions raised by these cases about the sufficiency of disclosures and knowing and voluntary consent (10 minutes)
    • The use of motor vehicle data as evidence in litigation and at trial, including potential discovery and admissibility issues (10 minutes)
    • Best practices for mitigating risk associated with advanced driver assistance systems (ADAS), telematics and other motor vehicle technologies and the data they collect and use (10 minutes)

Who Should Attend: In-house counsel, outside attorneys, litigators, privacy, technology, and other allied professionals interested in staying up to date on the legal and regulatory issues associated with Autopilot and motor vehicle technology
