IP Discussions with Joshua Simmons is a series of conversations hosted by nationally recognized intellectual property litigator, Joshua Simmons. Each month, Josh is joined by a panel of IP luminaries, leading scholars, and industry insiders. Together, they examine major topics and events in a civil, roundtable format.
Dilution claims are intended to protect famous marks from unlicensed uses that create an association with them impairing their distinctiveness, as well as uses that harm their reputation. Yet, as courts have recognized broader claims for trademark infringement, some commentators have questioned the independent utility of dilution claims. At the same time, scholars have analyzed whether the proliferation of trademarks has led to a depletion of available words that may be selected as new trademarks.
