Overview

Several insurance trends have emerged in the first half of 2024, including a series of procedural victories by policyholders fighting back against declaratory judgment lawsuits filed by their insurers. These decisions provide guidance for other policyholders in similar predicaments. In addition, several new kinds of underlying claims have emerged against policyholders facing lawsuits for alleged damages caused by social-media addiction and climate change. 

This presentation will analyze legal issues presented by these cases, examine the legal reasoning behind the outcomes, and predict future coverage battles in the second half of this year and beyond.
