    This session will review the process and implications of bringing emergency applications before the Family Court in child custody, visitation, and family offense matters. After completing this session, participants will be able to:

    • Understand what constitutes an emergency in child custody, visitation, and family offense cases, including the specific legal standards and evidence required to support these applications
    • Identify New York's jurisdiction rules under the UCCJEA, including scenarios where temporary emergency jurisdiction can be granted and the steps to take when filing an emergency application.
    • Master the procedural steps for filing an emergency application
    • Understand how judges decide on emergency relief, the standards for granting ex parte relief, and the importance of balancing due process with protecting the petitioner.
    • Explore follow-up hearings, long-term relief, and the enforcement of emergency orders, including the legal consequences of violating such orders
