Overview

Now that the U.S. Supreme Court has ruled on Biden’s forgiveness plan, payments are scheduled to restart on federal student loans after the pause ends on September 1, 2023.  Many changes have occurred over the past three years during Covid-19 which can greatly benefit student loan borrowers, such as the IDR Waiver and One Time Account Adjustment, PSLF modifications, expansion of Repaye, Total and Permanent Disability Discharge future income waivers, Joint Spousal Consolidation loan separations, and new Department of Justice rules finally allowing for discharge in bankruptcy.

This session will discuss:

  • The current state of repayment – expiration of the pause, the Supreme court ruling on the Biden 10k/20k forgiveness (10 minutes)
  • Upcoming deadlines for various forgiveness opportunities (5 minutes)
  • Benefits of consolidation to a Direct Consolidation Loan (redating all to earliest loan repayment date, one-time account adjustment, Repaye IDR; credit toward PSLF) (10 minutes)
  • Backdoor to PSLF for those who missed the October 31, 2022 deadline (5 minutes)
  • Discharge in bankruptcy – new DOJ attestation rules and practice tips (15 minutes)
  • Joint Spousal Consolidation loan separation and Total and Permanent Disability Discharge – new rules (5 minutes)
  • What consumer laws, legal, and advocacy approaches are available for attorneys to address private student loans, deadline for tax free settlement (10 minutes)

Who Should Attend:  All attorneys who are interested in helping to reduce student loan debt whether for their clients or themselves.  When we hear the words ‘student loans’, we think of the millennial generation. However, student debt is no longer just a young person’s problem.  In June of 2023, the Federal Reserve shows over $1.75 Trillion of student loan debt, 92% of which is federal loans.  This proves the problem hasn’t gone away and will continue to be a significant household expense preventing borrowers’ from starting a new business, buying a home or starting a family.
