The federal banking regulators are increasingly signaling that individual liability is on the rise, and, in late 2018, the Office of the Comptroller of the Currency issued its new Policies and Procedures Manual for enforcement actions against institution-affiliated parties (IAPs) of national banks, federal savings associations, and federal branches and agencies of foreign banks.
In this presentation, Michael A. Mancusi and Kevin M. Toomey of Arnold & Porter LLP will discuss:
- banking agency procedures for initiating individual enforcement actions;
- the standards the agencies must meet when pursuing such actions;
- defense considerations;
- indemnification issues; and
- recent enforcement actions against IAPs.
