Overview

Why You Should Attend
Financial elder abuse is defined as the illegal or improper use of an elder’s funds, property, or assets, including, but not limited to misusing or stealing an older person’s money or possessions, coercing or deceiving an older person into signing any document, and the improper use of conservatorship, guardianship, or power of attorney. Over half of the perpetrators in financial abuse cases are family members of the victim. Financial exploitation can lead to monetary loss, financial dependence, psychological decline, and compromised physical wellness. Civil attorneys are necessary to deploy legal strategies and advocacy to mitigate the effects of abuse and help older adults attain the remedies they seek.

This training will provide information and resources to help attorneys as they represent clients who may have experienced financial exploitation.

What You Will Learn
After completing this program, participants will be able to:
• Analyze ethical issues, including conflicts and capacity concerns, in financial elder abuse cases
• Integrate safeguards into elder abuse intakes to prevent ethical breaches
• Strategize and implement causes of actions against financial institutions in scam cases
• Write compelling demand letters in financial abuse cases 
• Devise a plan for incorporating demand letters into your overall legal strategy

Who Should Attend
Practitioners who work with older adults and caregivers and are seeking a better understanding of financial exploitation and how to assist victims of financial elder abuse. The training will explore emerging issues and trends in financial exploitation, and provide practical information for practitioners who are new to aging and elder law issues, as well as practitioners with elder law experience who are looking to deepen their understanding of financial elder abuse remedies.
