Criminal Prosecutions Under the California Cartwright Act

Overview
In March 2024, the antitrust chief of the California Department of Justice announced that the Attorney General’s Office intends to revitalize criminal antitrust prosecutions under the Cartwright Act, one of California’s primary antitrust laws. The Attorney General’s Office has not brought a criminal prosecution under the Cartwright Act in over 25 years.
The panel, who regularly assists clients with navigating federal and state criminal antitrust investigations and prosecutions, will discuss the new policy and its implications, including:
- A primer on criminal prosecutions under the Sherman Act and the Cartwright Act, and a comparison of the two statutes (15 minutes)
- A summary of the recently announced shift in the California Department of Justice’s policy (10 minutes)
- A discussion of the implications for companies and individuals, including an analysis of possible defenses (35 minutes)
