Overview

Wondering how to make product claims that “look,” “feel,” and “perform” better than the competition? The FDA’s authority to regulate cosmetics received its most significant expansion since 1938, and the FTC recently released wide-ranging guidance for health-related products. This presentation will discuss the ever-evolving regulatory, self-regulatory, and class action activity in the cosmetics and dietary supplement space, ranging from challenges to “naturally-derived” ingredients to claims over the presence of per- and polyfluoroalkyl substances (PFAS).

This Briefing will discuss legal compliance and recent developments in the following areas:

  • Advertising law basics, as foundational for cosmetic and dietary supplement advertisers (10 minutes)
  • Product claims and classification, focusing on the line between cosmetics, supplements, and drugs (5 minutes)
  • Cosmetics, with a focus on the Modernization of Cosmetics Act and recent enforcement actions (15 minutes)
  • Dietary supplements, with a focus on the FTC’s Health Products Compliance Guidance and recent enforcement actions (15 minutes)
  • Class action challenges, providing an overview of current trends in class action litigation and strategies to handle such (15 minutes)
