Overview

Biometric information, in its many forms, is now a focus of data privacy and cybersecurity legislation such as the CCPA, the BIPA, and the SHIELD Act.  Biometrics laws impose duties on the collection, use, and retention of biometric information and can give rise to regulatory penalties as well as civil actions.  The increasing number of putative class action lawsuits that have been filed across the country, and the attention that the use of biometrics has received from regulators makes it critical for businesses and their lawyers to understand what must be done to comply with biometrics laws and to be prepared to defend against litigation that may be brought against them for alleged violations of these laws and misuse of biometric information.
