What You Will Learn

PLI’s Advanced Patent Prosecution Workshop 2021 features clinic sessions and workshops organized into four technology sections: Biotechnology, Chemical/Pharmaceutical, Electromechanical and Electronics/Computers. Concurrent breakout clinics will address and discuss advanced specification and claim drafting issues, as well as patent prosecution matters of importance. Concurrent workshops will provide realistic claim drafting and amendment writing exercises, practical techniques to avoid prosecution pitfalls and tips to obtain strong, durable patents equipped to withstand patentability challenges.

Additional lectures will focus on ethical considerations in patent prosecution, lessons learned from post-grant proceedings, best practices to address invalidity and enforcement issues at the USPTO, statistics and strategies for appeals before the PTAB, revival of patent applications, and roundtable discussions in advanced patent prosecution issues.

Highlights include:

  • A deep dive into drafting patent specifications, including the written description, enablement, and best mode requirements of 35 U.S.C. § 112, drafting the specification to support claims in the major foreign jurisdictions, and practical tips for ensuring the specification is truly a primary source of claim interpretation
  • A review of advanced claim drafting issues specific to each technology discipline, focusing on language and techniques to avoid, tips for improvement and recent Federal Circuit case law applicable to each technology
  • Advanced discussions in post-KSR decisions and strategies for avoiding prosecution disclaimer and prosecution history estoppel, subject matter eligibility, compliance with the duty of disclosure, performing Examiner interviews, and Track 1 prioritized examination specific to each technology
