Overview

The process of design and construction, especially involving large scale projects, has the potential of creating disputes among the various project participants. This program will provide practical advice from the owner’s perspective for avoiding and resolving disputes during and after the course of the project, whether they involve unanticipated costs, delayed completion, design errors or omissions, or schedule delays.

Faculty from an owner’s representative firm and attorneys having extensive experience in construction contracting and litigation will discuss the following topics:

  • The process of transferring the risk of cost, schedule and quality of the work to the construction manager through contractual provisions (20 minutes)
  • Managing risk in the preconstruction and construction phases of the project by establishing cost, schedule and performance protocols (20 minutes)
  • Analysis of claims of the owner and contractors and the preparation for alternative dispute resolution procedures (20 minutes)
