Overview

On August 8, 2022, President Biden signed into law the Sergeant First Class Heath Robinson Honoring Our Promise to Address Comprehensive Toxics (PACT) Act which significantly expanded Veterans Affairs (VA) benefits and services to those exposed to toxins while serving in the military. The law establishes a list of more than 20 specific conditions that the VA will presume to be caused by toxins and environmental hazards, such as burn pits. The PACT Act also expands the list of presumptive-exposure locations and conditions related to Agent Orange, an herbicide widely used during the Vietnam War. Lastly, the new law creates entitlement to VA healthcare services for qualifying veterans, and expands access to monetary benefits for surviving spouses and children of toxic-exposed veterans.

During this presentation faculty will:

  • Overview the PACT Act and provide a brief review of VA Service-Connected Disability Compensation- 10 minutes
  • Review the new presumptive conditions under the PACT Act and requisite criteria - 30 minutes
    • Gulf War and Post-9/11 veterans
    • Vietnam veterans
    • Radiation-exposed veterans
  • Provide information on VA survivors benefits for family members of toxic-exposed veterans - 5 minutes
  • Provide information on new healthcare eligibility rules for qualifying toxic-exposed veterans - 5 minutes
  • Review additional programs and services created by the PACT Act including new VHA facilities and toxin screenings for veterans - 5 minutes
  • Provide advocacy tips and procedural information on applying for VA benefits under the PACT Act with updated information from VA on when veterans can expect to begin receiving healthcare and benefits - 5 minutes
