Overview
Economic downturns often trigger the need to reduce costs, including reining in generous benefits and reducing employee headcount. However, these changes will often implicate compliance with various state and federal laws involving labor, employment, tax, and benefits issues. In addition, these changes will require considerable documentation to support the employer’s actions if later challenged by a former employee or the government. During this program, our panel will focus on three main topics:
- Reducing Wages or Benefits: The labor/employment and employee benefits implications of reducing wages or benefits (20 minutes)
- Reductions in Headcount: The labor/employment and employee benefits issues arising from reducing headcount (20 minutes)
- Documenting Severance Arrangements: The various documentation and timing requirements, including issues relating to deferred compensation (Code section 409A) and golden parachutes (Code section 280G) (20 minutes)
Who Should Attend: In-house counsel, outside attorneys, compliance, human resources executives, employee benefits directors and managers, and other allied professionals participating in employment and employee benefits decisions and administration
