Overview

This program will explain the newly issued final trademark rules, effective December 18, 2021, in the United States Patent and Trademark Office (USPTO). The program will be important for both United States and international trademark prosecution and litigation lawyers (both in-house and outside counsel) and also corporate trademark development and clearance personnel. 

The final rules implement the Trademark Modernization Act of 2020. The speakers will explain and detail the new rules, including the provisions for expungement and reexamination proceedings, changes to existing Letter of Protest procedures, and the new timing for responding to Office Actions. Coverage also will include the specific operation of the rules and timing in the overall context of USPTO prosecution and litigation. Further, the new proceedings and changes will be examined from the perspective of not only the intended purposes of the rules as stated in the legislative and administrative histories, but also, the potential ramifications of the rules as they actually impact client goals, budgets and timetables. Such ramifications include possible adversarial proceedings in the USPTO as well as U.S. court litigations and multinational trademark conflicts.

Topics to be addressed include:

  • The new rules, how they work, and applicable deadlines (15 minutes)
  • Corresponding sections of the Modernization Act, with pertinent legislative and administrative histories (15 minutes)
  • The interaction between the new U.S. rules and international trademark protection and practice (10 minutes)
  • Potential adversarial ramifications in the TTAB, U.S. courts, and foreign tribunals (20 minutes)
