Overview

Why You Should Attend

Electronic information is all-pervasive and its use and misuse can pose serious ethical problems for attorneys. Attorneys and litigators in particular use electronic information to communicate with the public and with clients, to advertise their services, and to prosecute and defend litigation. Electronic communications have expanded to include “new” technologies  that pose expanded opportunities and risks for attorneys.

This program will address the cutting-edge ethical issues arising out of the electronic information that attorneys use daily. The program will consider ethical issues related to, among other things, the remote practice of law and the exploding use of artificial intelligence and generative artificial intelligence. Hear from our experienced faculty of Judges and private practitioners who represent plaintiffs as well as defendants in civil litigation.

What You Will Learn

After completing this program, participants will be able to:

  • Comply with the “technology” amendments to the Model Rules of Professional Conduct
  • Demonstrate the baseline knowledge a competent attorney should have to deal with electronic information
  • Understand the protection of confidentiality when using electronic information
  • Identify the risks of waiver of attorney-client privilege and work product as well as confidentiality
  • Perform the duty to supervise third-party service providers
  • Manage the ethical use of social media for professional and business purposes
  • Provide advice to a client about using social media ethically
  • Investigate the ethical use of social media by witnesses and jurors
  • Recognize the ethical “do’s and don’ts” of communicating with judges
  • Appreciate ethical issues that may arise when filing documents electronically
  • Engage in the remote practice of law in an ethical manner
  • Integrate artificial intelligence into the practice of law and use generative artificial intelligence in an ethical manner
