Overview

While we always hope that a construction project goes smoothly, often problems arise that lead to increased costs for the owner. What is the owner’s recourse to recover those costs? Using a comprehensive case study involving a construction project plagued by design errors and construction defects and delays, this program will explore the owner’s remedies against its architect and engineer team and general contractor/construction manager. This program, led by experienced construction attorneys and a damages consultant, will address actual, consequential and liquidated damages recoverable by the owner.

Topics will include:

  • Claims against the A/E team for errors and omissions; the standard of care and the calculation of damages [15 minutes]
  • A/E delay claim analysis; the limitation of liability of the A/E team and insurance coverage [15 minutes]
  • Claims against the GC/CM; contract provisions; damages against the GC/CM for breach of contract [15 minutes]
  • Schedule analysis; and claims of the GC/CM for changes, delays and damages [15 minutes]
