Overview

The Anti-Kickback Statute (AKS), False Claims Act, and Stark Law remain constant avenues for potential enforcement actions against healthcare providers by the U.S. Department of Justice, the Office of Inspector General for Health and Human Services, and the Centers for Medicare and Medicaid Services.  Those three agencies continue to scrutinize healthcare arrangements for compliance with those laws, sometimes with tens of millions of dollars as penalties for non-compliance.  A panel consisting of industry and legal practitioners and former government officials will discuss these issues and more as they:

  • Address recent developments in AKS/Stark Law and safe harbors/exceptions; (20 minutes)
  • Discuss how these changes impact enforcement in 2022; and (20 minutes)
  • Offer tips relating to how valuations and calculation of fair market value and commercial reasonableness can help avoid or mitigate enforcement actions. (20 minutes)
