The CFPB, FTC, HUD and Federal banking agencies are making leadership and priority changes to realign themselves with pre-Trump administration goals and embrace new priorities, including reinvigorating consumer protection and pursuing racial justice initatives. State regulators and attorneys general, which stepped up to fill the void during the Trump administration with increased enforcement, are seizing on a fresh opportunity to collaborate with their Federal partners to move their agendas. The volume of private litigation, particularly under the TCPA and FCRA, also remains high. At the same time, the recovering U.S. economy and the increase in technological innovation (including artificial intelligence, data aggregation and Blockchain) has continued to spur new entrants into the consumer financial services industry and the offering of new products by existing players in the industry.
