Beginning October 13, 2021, the Registration Exam will be updated to test the current version of the MPEP. The only substantive difference between the current MPEP and the earlier version currently tested on the Exam is the inclusion in the new MPEP of the US Supreme Court's decision in Helsinn that secret sales DO constitute prior art.
So, on any exams taken before October 6, 2021, secret sales do NOT constitute prior art. On any exams taken on or after October 13, 2021, secret sales DO constitute prior art. (The Exam will not be available October 6-12 while they update the software on all of the Prometric testing centers.)
