AREAS OF PRACTICE
Mr. Bernfeld, a bankruptcy lawyer by training, has focused his practice on real estate for the past 25 years, where he counsels clients in the areas of financing, workouts, leasing, acquisitions/dispositions, and creditors' rights. Recent experience includes the representation of institutional lenders and special servicers in the restructuring and enforcement of lenders' rights against various forms of real property collateral, including both fee and ground leasehold interests in retail, office, industrial, and condominium development communities.

Mr. Bernfeld is a member of K&L Gates' Distressed Real Estate Task Force and co-chairs its committee on special servicers. Specific examples of his distressed real estate and workout experience include representation of :

  • A pension fund with respect to the foreclosure of a 52-unit partially constructed condominium project in San Francisco, California
  • A pension fund with respect to the appointment of a receiver and the foreclosure of a 118-unit condominium project in Grand Rapids, Michigan
  • A foreign bank relative to foreclosure and disposition of a construction loan on an industrial condominium project in Alhambra, California
  • A foreign bank with respect to its restructure of an approximately 1000-unit self-storage/vehicular storage facility in Costa Mesa, California
  • A special servicer in connection with the restructure of A and B notes secured by a major sports merchandise warehouse in Los Angeles, California
  • A special servicer relative to a restructure of debt on a  Class A high-rise office building in Costa Mesa, California
  • A special servicer relative to a Chapter 11 plan of reorganization for the anchor tenant of a large retail center in Murietta, California
  • A major California bank with respect to the resolution of mechanics lien issues and construction defect claims arising during the completion of a 375-room hotel serving the California Adventure theme park adjacent to Disneyland in Anaheim, California
  • A major national bank in connection with the restructure of a construction loan for the renovation of an historic 300-room hotel in Hollywood, California
