Todd Flaming

I fought a five-year patent dispute for the largest U.S. manufacturer of printing presses in a case involving its core postpress patent against its largest competitor in the postpress industry. I won a favorable ruling from the Magistrate Judge, District Judge, Special Master, and subsequent District Judge who handled the trial on the Markman issues. After further favorable rulings on our motions in limine and jury instructions, the defendants settled the case on the eve of trial.

A major software producer of web load balancing software hired me to defend its Fortune 500 customers when sued for patent infringement based on the use of the producer's technology. After a hard-fought battle, the plaintiff-represented by one of the city's top trial lawyers-voluntarily dismissed the case.
I tried and won a case for an Internet provider in a case involving allegations that its software was deficient, using novel proof of invisible software robots designed to stop the opposing party's efforts to spam newsgroups before Internet was a household word.

My experience also includes defeating several class actions by obtaining denials of motions for class certification, winning favorable verdicts at arbitrations, effectively representing clients at mediations, and handling depositions around the United States and in other countries.
