Stephen Elliott’s practice focuses on complex commercial litigation in matters involving antitrust, intellectual property, and technology. As a patent litigator, he has focused on pharmaceutical patent infringement actions, primarily in the Hatch-Waxman context. He has also defended infringement claims concerning a variety of other technologies, including computer hardware and software, biotechnology, medical devices, and business methods. In the antitrust area, he has extensive experience in negotiating and defending pharmaceutical patent litigation settlements, and has also defended Robinson-Patman and patent misuse claims. When representing clients on technology, patent, and litigation matters, Mr. Elliott draws on his years of experience as a chemical engineer in the semiconductor and biochemical industries. Mr. Elliott is co-chair of the Technology and Intellectual Property Litigation committee of the Commercial and Federal Litigation Section of the New York State Bar Association.
