PETER H. KANG is a patent and IP trial attorney and a member of the firm’s nationally ranked Intellectual Litigation practice. He is also the IP lead for the firm’s Korea practice and coordinates with the firm’s Technology & IP Transactions practice. Peter has practiced IP law in Silicon Valley for over 25 years and currently serves as Palo Alto office chair for the firm’s Diversity Committee. He recently won a complete defense verdict as lead counsel in a patent jury trial, including a post-trial award of over $4.6 million in attorneys’ fees and costs for his client. He has taken a dozen cases to trial, seven as First Chair/lead trial counsel.  He also represents clients before the Patent Trial & Appeal Board, including a victory in the first ever IPR to reach final judgment.

Peter appears in the Federal Circuit, the ITC and federal courts nationwide. He also represents clients in high-tech commercial litigation and in other IP litigation, including trade secret disputes and copyright/trademark suits. He has argued dozens of pretrial motions, including successful dispositive motions and motions to transfer venue, and has presented patent claim construction arguments to courts across the nation, including tutorials, direct examination, and cross-examination of expert witnesses at Markman hearings and trials. He has also arbitrated complex international licensing issues before the ICDR.

Peter also represents clients as lead negotiator in licensing disputes worldwide. Peter further advises clients in IP valuation and due diligence in connection with M&A, offerings, and other corporate matters, as well as for IP and portfolio strategy.

Early in his career, Peter served as a Law Clerk for the Honorable Ernest C. Torres, former Chief Judge of the U.S. District Court for the District of Rhode Island. Prior to his legal career, Peter worked as a computer programmer and research assistant for a biomedical research organization at Brown University and for a cardiac research department at a public hospital in Rhode Island.

Peter has served as a Neutral in over 25 cases, both in federal and state courts. He has been appointed as Settlement Conference Officer for the San Francisco Superior Court in over ten cases. He has presided as Judge pro tempore in Santa Clara County Superior Court. He also has served as Court-appointed Mediator in complex patent suits. Peter also has served as a Court-appointed Arbitrator and Early Settlement Conference Neutral for the Santa Clara County Superior Court in over 15 cases, including successfully issuing an opinion which was adopted by the litigants and the Court as a judgment of the Court.

Peter is widely recognized for his IP work.  He was named “Intellectual Property Lawyer of the Year – USA” by Finance Monthly Law Awards 2016.  He has been recognized by numerous publications such as The Best Lawyers of America for Intellectual Property Litigation (2016), Chambers Asia Pacific as Band 1 in “Intellectual Property: International Firms – South Korea” (2014-2015) and Band 2 (2016), The Legal 500 Asia Pacific 2015 as a Leading Individual, Managing Intellectual Property as an “IP Star” for the United States (2014) and for California (2013-2014), Diversity & the Bar as a Rainmaker in the field of Patent and IP Litigation (2013), and in American Lawyer Media and Martindale-Hubbell as a “2014 Top-Rated Lawyer in Intellectual Property Law,” a “2013 Top Rated Lawyer in Technology,” a “2013 Top Rated Lawyer in Commercial Litigation,” and a “2012 Top Rated Lawyer in International Law & International Trade.” Each year from 2007 to 2015, Peter has been recognized by Northern California Super Lawyers and San Francisco Magazine in areas including Intellectual Property Litigation, International and Intellectual Property. He has also been listed in the International Who’s Who of Patent Lawyers (2013), Who’s Who in American Law and is a Life Member in the National Registry of Who’s Who

Peter has spoken at numerous industry, academic, and legal conferences, including the First Circuit Judicial Conference, the Consumer Electronics Show, and various law schools. Peter is a #1 ranked and award-winning author, and has published numerous articles including scholarly journal and peer-reviewed articles, and his writings have been cited in a published federal court opinion, law school curricula, and in multiple scholarly law journal articles. He has been quoted in numerous articles on IP law and industry issues, such as cloud computing.
