Patrick Maxcy is a partner in Dentons US LLP’s Restructuring, Insolvency and Bankruptcy practice.  He represents creditors and other significant stakeholders in Chapter 11 cases and out-of-court restructurings.  Patrick also has significant experience representing parties in cross-border insolvency proceedings. Patrick has extensive experience representing lenders, landlords and other parities in interest in real estate related bankruptcy and restructuring matters.

Representative Engagements

  • Patrick represented the primary lender to a 100+ store home furniture retailer in connection with an out-of-court debt and real estate restructuring.
  • Patrick represented the lender in successfully opposing a 600 rental unit debtor’s attempt to extend automatic stay to debtor’s insiders.
  • Patrick represented the lender in defeating SARE office park developer’s proposed cram-down plan and attempt to relieve insider guarantor obligations.
  • Patrick represented the owner of a chain of assisted living facilities in connection with out-of-court debt restructuring.  
  • Patrick represented lender in obtaining relief from the automatic stay to foreclose on property of bankrupt golf course operator.
  • Patrick has represented banks and special servicers in out-of-court restructurings and bankruptcy proceedings throughout the United States.
  • Patrick has represented landlords and other real estate interests in numerous retail and other large Chapter 11 bankruptcy cases throughout the United States.
