After many years of discussion, the ABA recently amended the Model Rules of Professional Conduct to add 8.4(g), a provision that is termed the anti-harassment and anti-discrimination provision.  Twenty five states have a version of the anti-discrimination provision in its rules. Ellen C. Yaroshefsky, Howard Lichtenstein Professor of Legal Ethics and Director of the Monroe H. Freedman Institute for the Study of Legal Ethics at The Maurice A. Deane School of Law at Hofstra University will: 

  • Consider the history of Rule 8.4 (g);
  • Consider the Rule’s various provisions; and
  • Consider state variations.
