Mediating Complex Financial Services Disputes [01:03:09]

The mediation of disputes in the financial services industry provides principals and counsel a strategic and tactical opportunity to evaluate claims and defenses, communicate messages and glean information, and to structure creative and tailored resolutions that are often superior to traditional litigation outcomes.  This One-Hour Briefing addresses the distinct substantive and lawyering issues that arise in mediating complex financial services disputes, and it provides practical guidance that will enable counsel, insurers and neutrals to maximize the value of mediating disputes in this critical business sector.  

Expert faculty will discuss: 

  • How to approach key decisions in financial services mediations, including when to mediate;
  • The roles of the participants to a mediation;
  • Choosing the right mediator and venue;
  • Effective mediation submissions; and
  • Conducting the mediation, engaging in settlement negotiations, and what to do when negotiations fail.

In addition, faculty will divulge some of the United States’ most prominent and experienced financial services mediators’ practical advice and responses concerning these topics and more.  

The speakers are Jill R. Sperber, of Sperber Dispute Resolution, Inc. and Judicate West, and Pierre M. Gentin, partner at Cahill Gordon & Reindel LLP and former Global Head of Litigation at Credit Suisse AG.  Ms. Sperber and Mr. Gentin are, along with the Hon. Layn R. Phillips and Lindsay R. Goldstein, editors of PLI’s Financial Services Mediation Answer Book (2017)
