Marley Degner is a counsel in Pillsbury Winthrop Shaw Pittman’s Litigation practice and is located in the San Francisco office. She has experience representing both plaintiffs and defendants in a variety of commercial litigation matters, including litigation in state and federal courts. She has represented clients in matters such as breach of contract, wrongful termination, unfair competition, class actions, fraud/deceit, and corporate investigations. Ms. Degner also has experience in privacy matters. She is familiar with the guidelines issued by the Federal Trade Commission on issues such as data security and crafting effective privacy notices. She is also familiar with relevant federal statutes such as COPPA and the TCPA and the ways in which businesses can unwittingly run afoul of such statutes. Ms. Degner can also assist companies responding to a government request for customer data or metadata in a way that protects their reputation while complying fully with the law. She is also familiar with the types of litigation, particularly shareholder litigation, that follow a major data breach, and can assist clients in defending such lawsuits. She is knowledgeable regarding the privacy protections afforded by Article I, Section I of the California Constitution. Finally, she has provided advice and counseling on various defamation-related issues.

Pillsbury awarded Ms. Degner its inaugural 2012 Pro Bono Mid-Level Associate Fellowship, and she spent half of her time in 2012 working with the American Civil Liberties Union of Northern California. As part of her work with the ACLU, Ms. Degner filed a lawsuit challenging the warrantless search of cell phones by police at the time of arrest under the California Constitution. She also lead a successful campaign to convince the California Judicial Council to adopt a rule abolishing the practice of demanding “bail” as a prerequisite to challenging a traffic citation.

Ms. Degner is currently the Vice President and Secretary of the Board of Directors of CALICO: the Child Abuse Listening, Interviewing and Coordination Center and the chair of CALICO’s Fund Development Committee. She is also a member of the advisory committee for OneJustice, a non-profit organization that acts as the anchor for California’s network of nonprofit legal organizations. Ms. Degner received her J.D. from New York University School of Law in 2007.
