Commercial Litigation

Represent companies in a variety of business disputes, including patent infringement cases and breach of contract cases.  First-chair trial lawyer in a number of trials. 

 

Representative patent infringement cases:

 

ICU Medical v. RyMed Technologies (D. Del.) – lead trial counsel for RyMed in jury trial in 2012 on literal infringement of patents relating to ports for IV connectors.  Won defense verdict.

Trading Technologies v. SunGard (N.D. Ill.) – won summary judgment of non-infringement on software for display of trading of securities.  Affirmed by Federal Circuit in 2016. 

Sensormatic v. The TAG Company US LLC et al. (S.D. Fla.) - lead trial lawyer for Sensormatic in patent and trade secret bench trial in 2008 relating to Electronic Article Surveillance labels.  Won on all claims.  Affirmed by Federal Circuit.

Schindler Elevator v. Otis Elevator (S.D.N.Y.) – lead trial counsel for Otis in jury trial in 2011 concerning use of access cards to call elevators.  Lost at trial; reversed on appeal by Federal Circuit, which found the patent obvious as a matter of law. 

Honeywell International, Inc. v. Hamilton Sundstrand Corporation (D. Del.) - lead trial counsel in jury trial in 2005 concerning method for starting of an Auxiliary Power Unit.  Won defense verdict at trial, with the jury finding non-infringement and that the patent was invalid.
