Luis C. Schmidt

Luis Schmidt joined OLIVARES in 1991 and became a partner in 1993. He possesses nearly 30 years of intellectual property experience in all areas of IP, with a specialization in the areas of copyrights entertainment. He has represented the world's leading companies in the industries of music, film, software, television, shows, publishing, fine art, design and the Internet.

Luis Schmidt’s work in drafting a new bill related to digital rights will change the entire ecosystem of digital rights management in Mexico, for both rights holders and day to day internet users. It can be argued he is the most important IP lawyer in Mexico working in the field of media and entertainment as he is directly influencing the future of Mexico’s copyright law. The law will bring Mexico in context with international efforts regarding enforcement of copyright in digital networks. Mr. Schmidt’s focus on achieving fair and just intellectual property protection for his clients fuels his passion for writing and transforming the law. In meticulously drafting the law, he hopes to extend and enforce the perimeters of intellectual property protection.

Luis has participated as a litigator or consultant on the most relevant copyright cases in recent times, including a Supreme Court case versed on remuneration rights and the case of Presunto Culpable.

The entertainment group that he heads manages services in copyright law and related rights, and in other areas of IP as well, including trademarks, patents and design law. The level of expertise extends to rights of privacy and publicity, domain names and other IT issues, advertising -including sweepstakes and related marketing activities- just to mention a few. In connection with the foregoing fields or areas, the group works in litigation -including on the one hand, civil, criminal and administrative actions for validity or IP rights, infringement and IP anti-counterfeiting and piracy, and on the other hand ADR, in particular arbitration-; contractual and transactional -copyright licenses, merchandizing agreements, and all sort of contracts dealing with entertainment or media, including film and TV production, distribution and funding, music publishing and sound recording, and shows and concerts- and regulatory work before the Copyright Office, Patent and Trademark Office and any other agencies of the federal and local governments.

Mr. Schmidt has participated as a litigator or consultant on the most relevant copyright cases in recent times, including a Supreme Court case versed on remuneration rights and the case of Presunto Culpable. Most recently, he drafted and executed a successful strategy to bring Spotify to market in Mexico. He has an unparalleled knowledge of digital media and related copyright law in Mexico.

Mr. Schmidt has authored over 100 articles focused on entertainment law and intellectual property and is widely regarded as a leading expert in these areas. In 2013 Mr. Schmidt published a book that is a collection of his many articles,

“Intellectual Property, Past & Future”.

In 2008 Luis Schmidt contributed with a Mexican chapter to the book “Copyright Throughout the World”, published by Thomson West and Slike Von Lewinsky, of the Max Planck Institute.
