Kandi advises on privacy and data security issues, online advertising, and general advertising and marketing practices, including the Children’s Online Privacy Protection Act (“COPPA”), student privacy, and the Internet of Things. She counsels companies on the collection, protection, and use of consumer data and helps them develop and implement comprehensive privacy and security compliance programs. Kandi assists clients in responding to Federal Trade Commission (“FTC”) investigations involving potential violations of Section 5 of the FTC Act and COPPA. She also advises clients in preparing for and handling data security breaches.

Kandi spent eight years as a Senior Staff Attorney in the FTC’s Division of Privacy and Identity Protection, where she focused on consumer privacy, children’s and student privacy, data security, the Fair Credit Reporting Act (“FCRA”), and the Gramm-Leach-Bliley (“GLB”) Safeguards and Privacy Rules. Kandi helped implement the 2013 revised COPPA rule, including by developing staff FAQs related to COPPA compliance, assessing COPPA safe harbor compliance, and reviewing safe harbor and verifiable parental consent applications. She also investigated and prosecuted violations of the FTC Act, GLB Safeguards Rule, and the FCRA involving a range of brick and mortar and online businesses such as retail, social media, sharing economy, children’s apps, and online behavioral advertising.  Additionally, she was frequently invited to speak on panels about COPPA compliance and the FTC’s enforcement of Section 5 for data security and privacy matters.

As part of her tenure at the FTC, Kandi served on detail for six months to the United States Senate, Committee on Commerce, Science, and Transportation, where she worked on a variety of consumer protection issues including privacy, data security, vehicle safety and technology, and sports matters. Before joining the FTC, Kandi practiced at Hogan Lovells where she advised clients on HIPAA compliance and other health care matters.

Kandi received her law degree from Georgetown University Law Center, where she graduated summa cum laude, and earned her B.A. from Columbia University.
