Jasper Helder is an EU Customs & International Trade attorney who counsels multinational companies on EU export controls/sanctions and customs rules. In addition to his practice, Mr. Helder frequently speaks at seminars in Europe and abroad.

His outbound practice includes EU export controls and economic sanctions (both dual-use and military products and technologies) and the interaction between EU and US rules (e.g. ITAR and EAR). Mr. Helder assists many US clients with their EU compliance, and advises a range of multinationals on EU and UN sanctions compliance for countries such as Iran, Libya and Syria and interaction with US rules (such as CISADA and other sanctions regimes).

He also advises on customs classification (including Binding Tariff Information), valuation and transfer pricing (notably royalties/license fees and complex sourcing chains), rules of origin (including Binding Origin Information), the use of customs procedures and customs compliance with a focus on optimizing supply and sourcing chains for European market access. Mr. Helder has extensive experience with the EU common agricultural policy and related im/export issues.

His practice includes advice and litigation. He represents clients before European and national (customs, export and other) administrations and courts as well as before the EU Commission, its advisory committees and the European Court of Justice.

Representative legal matters

  • Represented clients in voluntary self-disclosures of unlicensed dual-use and military exports under EU and national export controls rules in various EU jurisdictions.
  • Represented clients in voluntary self-disclosures concerning breaches of EU sanctions in various EU jurisdictions.
  • Assisted a multitude of clients in setting up or reviewing trade compliance programmes and providing in-house compliance training to businesses, from executive level to sales managers and logistics staff.
  • Advised various global companies in different industry sectors on the impact of and compliance with EU sanctions against Libya, Iran, Syria, Myanmar and other countries and interaction with US and UN sanction regimes.
  • Advised a client on the EU sanctions against Iran and the restrictions for key technologies for the oil & gas sector, as well as the interaction of the EU sanctions with US government procurement regulations, CISADA and US Iran sanctions.
  • Advised various clients on EU and national blocking laws in relation to US Cuba sanctions.
  • Assisted a client in resolving diverging export controls classification decisions from various European authorities in relation to the clients products, including providing information and opinions to the parties to the Wassenaar Arrangement for export controls.
  • Advised an oil & gas exploration services client on the procurement of global export licenses under European export controls regulation for an equipment hub supporting their global operations.
  • Obtaining exemptions from authorities in EU countries for exportation of commodities and related payments under the EU sanctions against Ivory Coast.

After graduation in 1992, Jasper joined the Logistics Transport Customs & Trade practice of Dutch law firm Trenité Van Doorne. After a merger with UK firm Simmons & Simmons, he was responsible for that firm's Customs & International Trade practice until December 2007, when his team joined Bird & Bird LLP. He joined Baker & McKenzie with his team in May 2010.

He is a member of the legal committee of the American Chamber of Commerce in the Netherlands.
