In October 2016, the International Organization for Standardization (“ISO”) issued ISO 37001, Anti-bribery management systems. Described as a “series of measures to help organizations prevent, detect and address bribery,” ISO 37001 is intended to provide a uniform set of standards against which any organization can measure its anti-corruption program. While the substance of ISO 37001 is largely in line with prior guidance by U.S. and other authorities, many questions remain relating to how it will be applied in practice, how the certification process will work, the benefits of the certification, and how it will be viewed by regulators.
