Attracting and retaining legal talent in a highly competitive environment has become increasingly challenging as many lawyers become disillusioned by long hours, pressure to bill, limited advancement opportunities and a poor work/life balance. Workplaces that respect individuals’ contributions, support their professional and relational growth, and provide constructive feedback and fair compensation optimize lawyer engagement, commitment, performance, productivity, profitability and teamwork.

All organizations employing lawyers require periodic performance reviews to support compensation, promotion and retention decisions. Traditional reviews that emphasize employee mistakes and shortcomings have been shown to fail to improve performance, and can in fact be counterproductive, generating employee dissatisfaction and poorer performance. Alternatively, a more positively directed process that identifies an employee’s strengths, builds on previous success, balances negative feedback with constructive support and engagement encourages collaboration among supervisors and subordinates can build a culture where strengths are leveraged for future success.

In this Briefing, we will explore practical tools and steps to move the performance management system in a more affirming, prospective direction to build a balanced environment that supports individual lawyers, the organization and the bottom line.
