Fred Lochbihler, the senior partner in the firm's General Litigation Department, has been practicing law since 1976 when he joined Chapman and Cutler. Mr. Lochbihler represents corporations, banks and individual entrepreneurs as lead counsel in litigation of all types.  Although his forte is securities and shareholder litigation, he has substantial experience in litigating actions in the areas of RICO and common law fraud, lender liability, trusts and estates, insurance and reinsurance law, accountants' liability, products liability and performance, libel and slander, construction and environmental disputes, employer-employee relations, trademark and trade secret protection, unfair competition, and antitrust. Mr. Lochbihler has practiced in federal and state courts throughout the nation in connection with all variants of remedial actions including litigation, class actions, and injunction and declaratory judgment cases.
Representative examples include:
 

  • Served as lead litigation counsel in the takeover of a $100,000,000 privately-held Delaware corporation headquartered in Illinois
  • Defended trustees and executors in suits alleging massive investment failures, breaches of fiduciary duties and fraud.
  • Represented a large brokerage firm in connection with the SEC, FBI, U.S. Attorney and NASDAQ investigations and prosecutions of municipal bond fraud in New Jersey
  • Litigated several cases involving issues of the authenticity of significant works of art
  • Represented financial institutions in data processing conversion controversies
  • Represented banks and trust companies in class actions respecting trust fees and investments
  • Represented a CEO in the wake of a major company's failure as he became both plaintiff and defendant in securities law class actions, an SEC investigation and bankruptcy court proceedings


Mr. Lochbihler has spoken on securities legislation, lender liability, insider trading, and commitment letter litigation issues. In addition, Mr. Lochbihler has been cited as a leading attorney in a number of publications, including Martindale-Hubbell, "AV" (highest rating), Leading Illinois Attorneys, Who's Who in America, Who's Who in the World, Who's Who in American Law.
