Eric Walker focuses his practice on financial restructuring and bankruptcy, with experience representing debtors, creditors, examiners and trustees in bankruptcy proceedings throughout the country. Eric has particular experience in the hotel and hospitality industry, regularly counseling hotel owners, developers, lenders and major hotel brands in transactions, state and federal litigation, and bankruptcy.

Eric also has significant appellate litigation experience, briefing and arguing cases before various state appellate courts, the U.S. Court of Appeals for the Seventh and Ninth Circuits and the Supreme Court of the United States. Eric represented the petitioners before the U.S. Supreme Court in RadLAX Gateway Hotel, LLC, et al. v. Amalgamated Bank (Case No. 11-166), a high-profile hotel bankruptcy case involving secured creditor cram down.

Some other representative matters Eric has worked on include:

  • Lead counsel for CMBS special servicers in foreclosure actions, bankruptcy and appellate proceedings and out-of-court workouts nationwide
  • Representation of large private independent owner and hotel management company in various state court litigation and negotiations
  • Counsel for major hotel brand in Chapter 11 proceedings involving a portfolio of eight full service hotels across the country
  • Representation of major aircraft manufacturer in ATA bankruptcy case
  • Advise manufacturing company with valuation and purchase of intellectual property in Section 363 sale
  • Counsel for 1031 exchange creditors in bankruptcy proceedings
  • Defense counsel for private equity fund in WARN class action and state wage payment litigation

In October 2013, Eric was nominated as a member of the 2013 Next Generation Class for the National Conference of Bankruptcy Judges, designed to recognize “leaders of the next generation of bankruptcy practitioners.” Eric is the Education Director for the Real Estate Committee of the American Bankruptcy Institute and frequently writes and speaks on issues of bankruptcy and appellate law.
