David Onorato

Clients have been turning to David for his experience in complex banking and financial matters for over 20 years. He has been recognized as one of New York’s leading litigators by Chambers USA and Benchmark Litigation: The Definitive Guide to America’s Leading Litigation Firms and Attorneys. While David was the Director of Litigation at Bank of America, he was awarded Global Director of Litigation of the Year by the Association of Corporate Counsel.

David handles domestic and cross-border cases (in particular class actions and investigations) involving anti-money laundering, auction rate securities, derivatives, securities offerings, the Patriot Act and M&A transactions. He also handles inquiries by banking and securities regulators, including the Securities and Exchange Commission, State Attorneys General, and the Office of the Comptroller of the Currency. In addition, David counsels clients in M&A transactions, in particular regarding due diligence and regulatory issues.

David recently won dismissal of a class action arising out of the redemption of hundreds of millions of dollars in auction rate securities. Protas v. Merrill Lynch & Co., et al., No. 646555-VCG (Del. Ch. Ct. 2012). In his career, David has won numerous securities class actions, including one recognized by the American Bar Association as one of the year’s most significant securities law developments.

At Bank of America, David successfully resolved highly-publicized claims by State Attorneys General alleging predatory mortgage lending by Countrywide. He also negotiated industry-leading resolutions of the multi-billion dollar Enron and WorldCom securities class actions.

His clients include Bank of America/Merrill Lynch, Barclays, Deutsche Bank and Warburg Pincus, as well as other bank and non-bank multinationals.
