Taken from the briefing Business Search Warrants: A Primer recorded May, 2017 in New York.

A surprise government raid of a company’s offices can affect business operations, company morale, and the bottom-line. Employees will be separated and interviewed. Documents will be collected. And computers will be confiscated. The first moments of any raid will be critical to the authorities and, more importantly, the company’s defense. But how should the company respond? Where is the line between cooperation and obstruction? And what is the role of company counsel? In today’s business environment, it is paramount that companies have the proper controls and procedures in place for such a contingency in order to minimize risk and ensure that the company is poised to both cooperate effectively and preserve its ability to mount a vigorous defense. This briefing will examine the best practices on how to respond to the execution of search warrant and its aftermath.
