Brian D. Fergemann is a partner in the Advertising, Marketing & Privacy Law Practice at the Chicago-based law firm of Winston & Strawn LLP. He provides counseling on a wide range of advertising, marketing, intellectual property, and e-commerce issues to major national consumer product companies, retailers, and advertising agencies. He regularly counsels clients on consumer sweepstakes, contests and social media issues and has extensive experience in high-level talent, music, and sponsorship negotiations. He also represents clients in connection with government investigations into advertising and marketing issues. His clients include major U.S. companies such as The J.M. Smucker Co. and E. & J. Gallo Winery, Taco Bell and Michaels Stores.

Mr. Fergemann's publications include "Which Rule to Follow? New Challenges for Advertisers," e-Commerce Law and Policy, January 2011 and he is a regular speaker at national advertising and promotion law conferences.

Mr. Fergemann received a B.A., cum laude, from Michigan State University in 1996 and a J.D. from the University of Virginia School of Law in 1999, where he was on the editorial board of the Virginia Journal of International Law. He is Secretary of the Board of Directors of The Night Ministry, a non-profit organization that serves homeless youths and adults in Chicago. He is also pro bono legal counsel to the Chicago Advertising Federation.
