A significant change in the landscape of European patents will be arriving very soon, namely, the European Patent Office (EPO) will start granting a Unitary Patent.

This briefing quickly reviews the current EPO procedures and then explains how upon entering the grant phase, applicants will soon have the option to request a Unitary Patent, which will have effect in a significant number of European Union (EU) participating states, saving both time and costs associated with obtaining national patents. A related development, the Unified Patent Court, will allow patent owners to enforce Unitary Patents, or for a third party to request revocation of a patent. The new court system reduces costs and reduces the risk of diverging decisions and lack of legal certainty. The Unified Patent Court will have exclusive jurisdiction for litigation relating to Unitary Patents.
